1. Business Policy

1.1 Eligible users

The Services are available exclusively to individuals who are at least 18 years of age acting for personal, non-commercial purposes, referred to as Users or you. By placing an order, you confirm that you meet this requirement. Do Not Wish does not sell to businesses, resellers, or individuals acting in a trade or professional capacity.

1.2 Order monitoring and right to refuse

Do Not Wish reserves the right to decline any order for any reason, including orders that appear to be associated with fraudulent activity, resale intent, or patterns inconsistent with personal consumer use. Where an order is declined, we will notify you in writing.

We monitor order and return activity to ensure purchases reflect genuine personal consumption. Where return rates exceed 80% of total expenditure over a 12-month period, we reserve the right to restrict future purchases or decline returns after contacting the relevant customer for clarification.

1.3 Scope

These Terms apply solely to the purchase of products through the Services. They do not govern services or products offered by third parties whose links or content may appear on the Services. We recommend reviewing the terms and policies of any third parties before transacting with them. Do Not Wish is not liable for third-party transactions.

1.4 Marketplace role

Do Not Wish operates a marketplace through which independent brands, retailers, and other approved businesses (each, a "Partner") offer products for sale. Unless otherwise stated, the applicable Partner is the seller of record for a given product and is responsible for the accuracy of its listing, the legality and authenticity of its products, and compliance with applicable law. Do Not Wish facilitates checkout, payment processing, customer support, returns, and related services on behalf of the Partner.

2. Placing Orders

2.1 Order process

To purchase a product, complete the order form on the Services and submit it electronically. You will receive an acknowledgment confirming receipt of your order. This acknowledgment is not acceptance of your order.

2.2 Pre-order information

Before you submit an order, we will provide you with:

  • A summary of each product, including its main characteristics and unit price, inclusive of applicable fees and taxes
  • The total amount payable and applicable payment terms
  • Available payment methods
  • Delivery methods, destination, and associated costs
  • Any third-party charges we cannot determine in advance, such as customs duties
  • The currency in which amounts are expressed
  • Estimated delivery date

2.3 Order as offer

By submitting an order, you make an irrevocable offer to purchase the selected products. Before submission, you will have the opportunity to review and correct any input errors.

2.4 Order acceptance

Your order is accepted when we send a shipment confirmation email confirming dispatch of your products. Eligible orders may be canceled within 30 minutes of receiving the order confirmation, through Account Settings or the guest order-management link included in your confirmation email. After the 30-minute window, a cancellation may still be requested but is not guaranteed. Do Not Wish is not obligated to supply any product until a shipment confirmation has been issued.

2.5 Order records

Your order history is accessible through the Services. Order information is retained for the period required to process your order and as required by applicable law.

2.6 Incomplete or unavailable orders

Orders that are incomplete, contain errors, or relate to products no longer available may not be processed. If a product becomes unavailable after your order is submitted, we will notify you promptly and issue a prompt refund. A valid, active email address is required for order processing. We reserve the right to cancel orders submitted using invalid email addresses.

2.7 Agreement to terms

By submitting an order, you confirm that you have read and agree to these Terms, our General Terms of Use, Privacy Policy, and Return Policy.

3. Products & Prices

3.1 Product standards

Products offered through the Services are listed and sold by the applicable Partner. The Partner is responsible for the accuracy of its product listings and for the authenticity, legality, and quality of the products it offers, including compliance with applicable product-safety and consumer-protection laws, subject to Do Not Wish's marketplace obligations. Counterfeit, defective, and undisclosed second-hand products are prohibited on the marketplace. Where vintage items are offered, their condition will be described on the relevant product page.

Do Not Wish reserves the right to remove any listing or discontinue any product at any time without notice.

3.2 Product descriptions and images

Product characteristics are described on each product page as provided by the applicable Partner. Colors and images are for reference only and may not exactly reflect the physical product due to display settings or technical rendering differences.

3.3 Pricing

Prices are displayed in the currency corresponding to your browsing region and are subject to change. Please review the final price at checkout before submitting your order.

In the event of a pricing error, we will not accept the relevant order and will contact you to offer the correct price or cancel the order. If we are unable to reach you, the order will be treated as canceled.

Prices exclude applicable sales taxes, which are calculated and displayed at checkout based on the item type, purchase price, destination, and applicable law. The final tax amount confirmed in your shipment confirmation is the authoritative figure.

3.4 Geographic restrictions

Orders may only be placed from countries supported by the Services, as indicated at checkout.

3.5 Product tags

All products sold through Do Not Wish include an identification tag with a disposable seal. Removing this seal may affect your eligibility for returns.

4. Payment

4.1 Payment methods

Payment must be made using one of the methods presented at checkout.

4.2 Card payments

Credit and debit card information is transmitted via encrypted protocol to authorized payment processors. Card details are used solely to process your transaction, issue applicable refunds, and, where required, report fraud to relevant authorities. Your payment method will be charged when we are ready to dispatch your order.

5. Promotional Codes

From time to time, Do Not Wish may issue promotional codes that apply a discount to eligible purchases. The following conditions apply:

  • Each code may be used once per order, except where a return has been processed
  • Codes cannot be exchanged for cash or combined with other codes
  • Only one code may be applied per order
  • Codes apply to a single item order
  • Codes may only be applied to items with a value exceeding the code amount
  • Codes may not apply to sale or restricted items, as specified at the time of issuance

Specific terms and conditions for individual promotional codes will be communicated at the time of issuance.

6. Shipping & Delivery

Once your order is dispatched, you will receive a shipping confirmation email with tracking information.

Estimated delivery dates provided at checkout or in order communications are estimates only and are not guaranteed. Do Not Wish is not liable for delays caused by carrier operations, customs processing, or circumstances outside our reasonable control.

Risk of loss and damage passes to you when your order is collected by the carrier. Title to the products transfers upon carrier acceptance of the shipment.

7. Store Credit

Registered users may elect to receive store credit in lieu of a refund on eligible returns. Store credit is issued to your account and may be applied to future purchases through the Services.

Store credit:

  • Does not expire and is not subject to service or inactivity fees
  • Is non-transferable and may only be used by the account holder to whom it was issued
  • May be combined with other accepted payment methods for purchases exceeding the credit balance
  • Cannot be converted to cash or refunded to a payment card

Returns of items originally purchased using store credit will be credited back as store credit. Where store credit was used alongside another payment method, refunds will be allocated proportionally.

Do Not Wish reserves the right to modify the store credit program at any time. All use of store credit is subject to these Terms and our Privacy Policy.

8. Return Policy

Our Return Policy is incorporated into and forms part of these Terms. Please review it before placing an order.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Do Not Wish makes no representations or warranties, express or implied, regarding products sold through the Services, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

Where Do Not Wish is found liable in connection with a product, liability is limited to the purchase price of that product. Some jurisdictions do not permit certain liability exclusions or limitations; where applicable law restricts these limitations, they apply only to the extent permitted.

Residents of New Jersey retain the right to bring product liability claims under the New Jersey Product Liability Act (N.J.S.A. 2A:58C-1), seek punitive damages, and seek consequential damages for personal injury in connection with consumer goods.

10. Privacy

11. Force Majeure

Do Not Wish is not liable for any delay or failure to perform its obligations caused by circumstances outside its reasonable control, including natural disasters, governmental actions, labor disruptions, telecommunications failures, or other force majeure events.

12. Errors & Inaccuracies

We aim to maintain accurate, current information on the Services. However, typographical errors, pricing inaccuracies, and omissions may occur. We reserve the right to correct any errors and update information at any time, including after an order has been submitted.

13. Governing Law & Disputes

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles. Any legal proceedings arising from these Terms or a transaction conducted through the Services must be brought exclusively in the courts of the City of New York, State of New York. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

14. Amendments

Do Not Wish may update these Terms at any time. Updates are effective upon publication on the Services. We encourage you to review these Terms periodically. If any provision of these Terms is found to be invalid, void, or unenforceable, the remaining provisions continue in full force and effect.
